Terms of Service

The following terms and conditions govern all use of the NELSON RACING LLC website and all content, services, and products available at or through the website. The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, NELSON RACING LLC's Privacy Policy) and procedures that may be published from time to time on this Site by NELSON RACING LLC (collectively, the "Agreement").

1. Services

NELSON RACING LLC provides a range of digital marketing services including, but not limited to, Search Engine Optimization (SEO), Pay-Per-Click (PPC) advertising, Social Media Marketing (SMM), and Content Marketing. The specific details, scope, timelines, and deliverables of the services provided will be outlined in a separate Statement of Work (SOW) or client agreement.

2. Payment and Renewal

General Terms. By selecting a service, you agree to pay NELSON RACING LLC the monthly or one-time fees indicated. Payment for services will be detailed in the SOW. Typically, services are billed on a pre-pay basis on the day you sign up for a service and will cover the use of that service for a monthly or annual subscription period as indicated. Payments are not refundable.

Timelines. Project timelines are estimates and are not guaranteed. Delays caused by the client (e.g., late feedback, delayed access to accounts) may result in adjustments to the project timeline.

3. Client Responsibilities

The client agrees to provide all necessary access to information, data, and digital properties (such as website backends, ad accounts, and analytics platforms) required for NELSON RACING LLC to perform the agreed-upon services. The client is responsible for the accuracy and legality of all content, materials, and information provided to NELSON RACING LLC.

4. Confidentiality

Each party agrees to maintain the confidentiality of the other's proprietary information. NELSON RACING LLC will not disclose any confidential client information, including campaign data and business strategies, to any third party without prior written consent from the client, except where required by law.

5. Limitation of Liability

In no event will NELSON RACING LLC, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data. NELSON RACING LLC shall have no liability for any failure or delay due to matters beyond their reasonable control.

6. Termination

NELSON RACING LLC may terminate your access to all or any part of the service at any time, with or without cause, with or without notice, effective immediately. The terms for termination of a service contract will be specified in the SOW. Typically, a 30-day written notice is required from either party to terminate ongoing services.

7. Changes

NELSON RACING LLC reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes.
